Estrellita, Inc. is committed to protecting and respecting your privacy. If you access our website or applications, or purchase or use our products or services, this Privacy Policy (“Policy”), describes what information we collect, how we may use that information, and how we keep it confidential. If you disagree with this Policy, please discontinue using our services and/or purchasing our products.
This Policy is part of our online Terms of Use (https://estrellita.com/terms-of-use/) and any other agreement you may enter into with us (e.g., a software license agreement) (collectively, our “Terms”). All the paragraphs in the online Terms of Use and any other agreements you may enter into with us are included in this Policy as if specifically written here. This Policy may be updated from time to time. Updates or changes will be posted here.
Acquisition of Information. We do not acquire any more information about individuals purchasing or accessing our Products than is required to provide our Products to you, or is required by law, unless you provide it to us voluntarily.
In some instances, you may voluntarily submit information about yourself to us. For example, you may provide your name, shipping address, phone or email, and credit card information when you purchase a Product from us. If you opt not to provide Us with such information, you may be unable to have a purchase order fulfilled.
The legal definition of Personal Data varies by location. If you are located in the U.S., the legal definition in Colorado shall apply unless U.S. Federal law supersedes. If you are located outside the U.S., only the legal definition that applies in your physical location will apply to you under this Policy. Nothing in this Policy is meant to alter the applicable law of Colorado that governs this Policy and any disagreements regarding this Policy. You agree that all Claims (any type of dispute or disagreement) that you may have relating to our Terms shall be resolved pursuant to Colorado law and shall only be brought in a court of competent Jurisdiction located in the State of Colorado, U.S.A.
Our website is not meant for use by children. Some of our Products are meant for use by children. Personal Data of a child under 13 years of age (if received with parental or a guardian’s permission) will be destroyed when no longer needed for the purpose for which it was obtained. Personal Data of a child under 13 years of age received without appropriate permissions will be destroyed promptly when we learn of the child’s age. If a minor’s Personal Data is provided through a school or school district, that district agrees, warrants and represents that it has previously obtained parental or guardian written consent.
While third parties residing outside the U.S. may access our website (https://www.estrellita.com), we do not sell or distribute our Products outside the U.S. In the event we begin to distribute outside the U.S., we will update this Policy.
How We Use Your Information | No Sharing. We will use personally identifiable information, if you provide it, to us to provide you with our Products. We will use your Personal Data to provide you with additional information, materials and news about our Products that we believe may be of interest to you or to troubleshoot technical problems if you contact us. You may opt out of such communications by contacting us at info@Estrellita.com or by selecting the “unsubscribe” link available in each email we send.
We do not share Personal Data with third parties unless (a) you, or your parent or legal guardian in the case of a child lacking majority, authorize such sharing, (b) you or your children are using our Products for educational purposes through your educational institution and the institution has access to your Personal Data and use of our Products for assessment purposes, or (c) we are compelled to share Personal Data by an order of a duly‑empowered governmental authority (including, but not limited to, a court order) or to comply with laws or regulations. In the circumstances of (b) in this paragraph, such institution agrees, warrants and represents that it has obtained prior written authorization from the parents or guardians. In the circumstances detailed in (c) in this paragraph, your Personal Data or other information may be divulged without your consent.
Non-Personally Identifiable Information. We may also collect information that is not associated with a particular individual or is already available publicly, including Internet protocol (IP) addresses, device identifiers, and other technical information. We may use this information to improve our Products, our website performance, information security and for other internal purposes. We do not share this information with third parties.
Deletion or Correction of Personal Data. You have a right to request the deletion or correction of Personal Data in our possession or control. If you would like to review, correct, or delete any Personal Data you have provided to us, please contact us at info@Estrellita.com. We may request that you verify your identity prior to sharing information with you. If you have requested deletion, we will only maintain your request until we have completed the requested deletion and informed you of the completion of your request. Otherwise, we will maintain your request solely for our internal compliance records.
You may be able to access, correct, and/or request that we correct or update your Personal Data if you are using our online Products. You will be asked for your ID and password, if any, prior to making such changes or request.
Cookies. We may use “Cookies” which are data files created by websites you visit and stored by your browser that can be retrieved by the website when you next visit. By saving information about your visit, they make your online experience easier. For example, sites can keep you signed in, remember your site preferences, and give you locally relevant content. Cookies can identify a particular computer, but not an individual user. Third party entities that we use to provide functionality, analytics or through whom you have purchased or downloaded a Product may also use their own Cookies. We do not control use of Cookies by third parties and expressly disclaim responsibility for information collected through them.
You may block Cookies through your browser’s preferences and controls, but doing so may disable some of the features of our Products. We encourage you to review your browser’s Cookie preferences carefully.
As of the date of this Policy, our Site uses the following third-party services, which services use Cookies: Google Analytics and WooCommerce.
- We use Google Analytics for internal business purposes only to collect data from our Site to create reports/insights regarding use of that Site by customers and visitors solely for internal purposes in order to make our Site better, determine how many times a unique visitor (determined by browser and device) has accessed our Site or a particular Site page, and to determine when a visitor results in a Product sale. This software uses Cookies, including Cookies that let us know from where a unique user accessed our Site. Google’s Privacy Policy can be found here: https://policies.google.com/technologies/partner-sites. This software uses Cookies that share certain information with Google, including, the URL of the page you are visiting, your IP address, the app accessed, and a unique identifier for advertising.
- WooCommerce is a third-party open source e-commerce plugin, which we use in order to obtain your credit card information in order to sell Products, calculate shipping rates, and process payments on our Site. WooCommerce’s Privacy Policy may be found here: https://automattic.com/privacy/. WooCommerce does use Cookies. You may review those Cookies here: https://automattic.com/cookies/. WooCommerce collects Personal Data as we need your name, address, contact information, and credit card information to sell you Products and process orders for Products. We use this information for legitimate business purposes in order to process your order and to provide you with ongoing information about our Products.
We urge you to review these third-party privacy policies and the Cookies used. Also, if you have downloaded our Products or access our Products through a third-party application, we suggest you check that third party’s privacy policy and their Cookies.
Security of Your Information. It is important that you protect your ID and password to keep your information confidential and to protect your account, if any. Always be sure to log out when you are done using Products. We also take steps to keep usernames and passwords confidential. This information resides on password protected servers in the United States; and third-party service providers are required to maintain that information as confidential. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot ensure or warrant the security of any information you transmit to us or that we transmit to you. We disclaim any and all liability for disclosure of any information obtained due to errors in transmission or the unauthorized acts of third parties as more specifically detailed in our Disclaimers.
Linked Websites. Our Products do not provide links to other websites but may use third-party providers, such as Google Play or Apple iTunes, in order to license our software application Products to you. Such third-party sites may ask you for Personal Data – for instance, if you are purchasing a Product. We have no control over a third party’s use of any Personal Data you provide. We urge you to exercise care when providing Personal Data to anyone. We are not responsible for the privacy policies, Cookies, or content or data handling practices of other websites.
Email Inquiry. If you send an email inquiry to us, the return email address is used for the answer. we do not use the return email address for any other purpose and do not share it with any third-party.
Acquisition of Children’s Information on our Site. Protecting children’s privacy is especially important to us. It is our policy to comply with the Children’s Online Privacy Protection Act (COPPA) and all other applicable laws. Our Site is not intended for use by children.
If we learn that we have collected Personal Data from children under the age of 13, we will promptly delete it unless that information is provided to us by an educational institution or government entity with the written consent of the children’s parents or legal guardians. Acquisition of Children’s Information Through Our Products. Many of our Products are utilized for education and educational assessments and are intended for use by children under the age of 13. We do not condition a child's participation in any activity with our Products on the child disclosing more personally-identifying information than is reasonably necessary to participate in such activity. Such information may only be disclosed with prior parental or guardian consent as detailed herein. We collect no information about a parent or guardian or their child, other than that detailed in this Policy, unless you choose to provide information to us.
We ask that school districts, classrooms, parents and guardians carefully monitor their students’ and children’s activities in using our Products. We encourage parents and guardians to spend time online with their children and to participate in the activities that may be offered through our Products. We believe that there is no substitute for proper parental and school supervision. Children should be instructed to never provide personally-identifying information on any website or products without school, parent or guardian permission. We also recommend that children ask a school, parent or legal guardian for permission before sending Personal Data to us, or to anyone else online.
We do not include links to any third-party websites or social sharing tools in Products intended for such children.
Verifiable consent from a child's parent or legal guardian is required before collecting, using or disclosing Personal Data from a child under the age of 13 once we know that the individual contacting us is under 13. If we need to collect information about a child we know to be under 13 years old, the Product will specify exactly what information is being collected. We will only use that information for the child’s access to the Products or for ensuring Products work properly. For e.g., our technicians or a child’s educational institution may see Personal Data if a user experiences technical difficulties or the child’s educational institution may see such Personal Data in accessing assessments. We will maintain such Personal Data provided to us for one year (July-July) unless we are requested by a parent, legal guardian or educational institution to retain that information for a longer period.
If you are an educational institution, you agree that you have written parental or legal guardian permissions signed and on file prior to setting up user accounts for your students and have given public notice of the type of directory information or Personal Data to be disclosed to us, giving students and their parents or legal guardians the right to opt-out of such disclosure within a specified time period.
There are several exceptions that permit collection of a child's email address without receiving parental consent in advance:
- To provide parents or legal guardians with notice and to seek consent for communications with a child. Note: this may require collection of the parent's email address as well;
- To respond to a one-time request from a child;
- To respond more than once to a child's request; i.e., subscription to a newsletter, however, parental consent is required prior to the second communication;
- To protect the safety of a child who is using our Products; i.e., in a chat room; and
- To protect our Products and website or to respond to law enforcement; i.e., in the case of a website compromise.
Personal Data about children under 13 years of age may be needed to respond to their communication to us, such as to receive a publication. We will use commercially reasonable efforts to destroy Personal Data about a child immediately upon completion of its intended purpose once we know the request is not from an adult or if we are informed that no parental or legal guardian permission has been signed.
Other than as stated herein, we do not knowingly collect personally-identifying Personal Data from children, either directly or passively, except when a child voluntarily submits such information through (i) a “Contact Us” link on a child's area of our Products or (ii) a public posting area if such feature is available. We will never request personally-identifying information from a child in any of our public posting areas.
Online Stores Accessible Through Products. Please note that any online store that may be accessed from our Products is intended for parents, teachers and other adult purchasers over the age of 18 and requires the submission of personally-identifiable information to fulfill and service any transactions.
Public Areas of Internet. Please remember that any information you may disclose in any public areas or the Internet becomes public information. You should exercise caution when deciding to disclose Personal Data in these public areas.
Hackers. Our Products have security measures that are standard in the industry in place to protect the loss, misuse and alteration of the information under our control. While we make reasonable efforts to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party “hackers” from illegally obtaining this information.
